These Terms & Conditions describe the use of the websites and inquiry and communication services of Kissell Law Group, LLC (“Kissell Law Group,” “we,” “us,” or “our”), including kisselllawgroup.com and kissell.com. Please also review our Privacy Policy.
Website materials are provided for general informational purposes. They are not legal advice for your particular circumstances and may not reflect every legal development or factual distinction. Seek advice from a qualified attorney concerning your own situation. Prior results do not guarantee a similar outcome.
The choice of a lawyer is an important decision and should not be based solely upon advertising.
Visiting the website, using chat, calling, texting, submitting a form, or sending documents does not by itself create an attorney-client relationship or establish that the firm has accepted your matter. Representation begins only after the firm affirmatively accepts the matter and you and the firm agree to the terms of representation, ordinarily through a written engagement agreement.
A free consultation or intake conversation does not obligate you to hire the firm or require the firm to accept representation. An engagement agreement governs the scope of any representation and related fees. These website terms do not change an existing engagement agreement.
We treat information about your inquiry or matter as confidential consistent with applicable law and professional obligations. Information may be handled by authorized staff and service providers supporting the firm, as described in our Privacy Policy. Whether a communication is privileged depends on the circumstances and applicable law.
Provide accurate contact information and initially send only what is reasonably needed to explain your inquiry. Do not send original documents unless requested. Contact the firm if you need a more secure method of communicating or submitting sensitive materials.
Sending a message does not guarantee that an attorney will review it immediately or act before a deadline. Court dates, filing deadlines, license-related deadlines, and other time limits may continue to run while an inquiry is being reviewed. Unless the firm has accepted responsibility for your matter, you remain responsible for meeting those deadlines. Contact us by telephone if your inquiry is urgent.
We use Blazeo to support website chat and after-hours inbound calls and outbound follow-up. Its representatives assist with gathering information and routing communications to our firm. An intake or answering-service representative does not become your attorney and is not authorized to promise representation, a particular result, or a legal strategy on behalf of an attorney.
Communications through these services are subject to the confidentiality and service-provider provisions of our Privacy Policy. A response from an intake representative does not mean an attorney has reviewed or accepted your matter.
Program and purpose. If you affirmatively agree to receive text messages from Kissell Law Group, we may text you about your inquiry, intake, requested documents, consultation arrangements, fees or hiring decisions, appointments, and communications concerning a matter for which we have been retained. Your consent applies to the purposes disclosed when it is obtained. It does not authorize unrelated third-party marketing.
How consent is obtained. Consent may be obtained through a chat exchange, a telephone conversation, a written or electronic request, or another appropriate affirmative opt-in process. Merely viewing this page, accepting general website terms, or providing a phone number without an appropriate affirmative agreement does not by itself enroll you in a recurring text-message program. We obtain and maintain consent as required for the particular communication and applicable legal and service-provider requirements.
Voluntary participation. Consent to text messages is not a condition of hiring the firm or obtaining legal services. You may communicate with us by telephone or email instead.
Human communications. Our outreach calls and substantive text messages are placed or sent by people. We do not use autodialed marketing calls, prerecorded sales calls, or automated marketing text campaigns. We may use communications platforms to deliver messages and administer preferences.
Frequency and charges. Message frequency varies depending on your inquiry, responses, appointments, and matter. Message and data rates may apply under your wireless plan. Contact your wireless carrier regarding charges.
Opting out. Reply STOP to a text message to opt out. You may also make a clear request to stop by calling 314-669-4394 or emailing tomkissell@gmail.com. We honor applicable revocation requirements. An opt-out confirmation may be sent where permitted. After an opt-out, any resumption of text messaging requires an appropriate new affirmative request or consent.
Help. Reply HELP for assistance, call 314-669-4394, or email tomkissell@gmail.com.
Your number and communications preferences. Only consent for a number you are authorized to use, and tell us if the number changes or is reassigned. Opting out of text messages does not terminate an existing attorney-client relationship or suspend your obligations under an engagement agreement or a court order. We will use an appropriate alternative means of communication as needed.
Delivery limitations. Delivery and timing depend on your carrier, device, network, and service providers. Messages may be delayed or fail to arrive. Wireless carriers are not liable for delayed or undelivered messages. Do not rely on a text message alone to meet a legal deadline or communicate an emergency.
Privacy. We do not sell personal information. Mobile numbers and text-message opt-in data and consent are not sold or shared with third parties or affiliates for their marketing or promotional purposes. Consent is specific to Kissell Law Group and cannot be transferred to another sender’s messaging program. Providers acting solely on our behalf may process the information only to support our authorized communications and related obligations, without independent marketing use. See our Privacy Policy.
We use website traffic monitoring, analytics, and related technologies as described in our Privacy Policy. Third-party websites linked from our site have their own terms and privacy practices. A link does not constitute a guarantee of the accuracy, security, or suitability of an outside service.
Do not use the website or communication services to transmit unlawful material, impersonate another person, introduce malicious software, interfere with service, or attempt unauthorized access to information or systems.
Unless otherwise identified, website materials are owned by or licensed to Kissell Law Group. You may view and retain materials for your personal, noncommercial informational use, subject to applicable law. Other uses may require permission.
We use reasonable safeguards, but internet communications and website availability cannot be guaranteed. Nothing in these terms waives confidentiality duties, limits obligations under an engagement agreement, or restricts rights or remedies that applicable law or professional rules do not permit us to limit.
We may revise these website and communication terms by posting an updated version and revising the date above. A change to this page does not by itself expand a person’s messaging consent or amend an existing engagement agreement. Additional notice or consent will be provided where required.
